Nepal Now – Terms & Conditions

By accessing or using the Nepal Now mobile application (“App”) and related services (“Services”), you (“User”) agree to abide by the following Terms & Conditions. These Terms, together with the Privacy Policy, govern your access to and use of the App and Services.

1.    Definitions
    Unless the context otherwise requires, the following terms shall have the meanings below:

a)    “User/Customer” – Any individual who registers and uses Nepal Now Services.

b)    “Partner Bank(s)” – Banks responsible for issuing, managing, and controlling the prepaid card associated with the App. Partner Bank(s) manage all card operations, KYC, payments, and refunds.

c)    “Prepaid Card” – Virtual or physical card issued by Partner Bank(s) for loading funds and making payments via the App.

d)    “Tourist Visa” – Valid entry permit for foreign nationals to visit Nepal.

e)    “Fonepay Technology” – The technology provided by Fonepay enabling QR payments and facilitating prepaid card transactions.

f)    “Transactions” – Payments, fund transfers, or bookings executed using the App and prepaid card.

g)    “Third-Party Integrations” – Services integrated into the App such as Google Maps, Third party APIs, or merchant systems.

h)    “OTP/One-Time Password” – A time-sensitive, single-use password sent to a registered mobile number/email for authentication.

i)    “Security Credentials” – Username, password, OTP, or other authentication mechanisms used to access or authorize transactions in the App.


2.    Applicability of Terms

2.1. Registration Requirement: To use Nepal Now services, Customers must first register on the Nepal Now App in the format and manner prescribed by Nepal Now. During registration, Users must create their own Username and Password to securely access the App.
Users must be 18 years or older and legally capable of entering into binding contracts under applicable laws of Nepal.[NN1.1]

2.2. Access after Verification:

a.    Access to services such as prepaid card creation, QR payments, and third-party integrations is available only after successful registration and verification.

b.    Registration requires submission of a valid Passport, Visa, and contact information.

c.    Users must be physically present in Nepal, and Nepal Now may verify their location through GPS or other location verification mechanisms.

2.3. Acceptance of Terms: By registering or using the Nepal Now App, Users confirm that they have read, understood, and agreed to these Terms and Conditions. These Terms are binding on all Users who access or use the App and its related services.
2.4. Regulatory and Partner Bank Compliance: These Terms operate in addition to, and not in conflict with, any applicable laws, regulations, or Partner Bank policies governing prepaid cards and payment services. All rules, conditions, and procedures established by the Partner Bank(s) regarding card issuance, KYC verification, Anti-Money Laundering (AML) and Countering the Financing of Terrorism (CFT) compliance, payments, transaction limits, refunds, and dispute resolution shall continue to apply. 
Nepal Now and its Partner Bank(s) reserve the right to monitor, review, or report any activity deemed suspicious in accordance with their respective AML/CFT Policies and the directives issued by Nepal Rastra Bank (NRB).
2.5. No Additional Rights or Claim: Use of the Nepal Now App does not create any legal, contractual, or financial rights beyond those specifically stated herein. Nepal Now, the Partner Bank(s), and third-party service providers are responsible only for obligations clearly defined in these Terms.
2.6. Disputes and Grievances:

a.    If any dispute or grievance arises regarding App functionality, registration, or service access, Users may contact Nepal Now at [email protected]

b.    Nepal Now will acknowledge all valid grievances and resolve them, coordinating with relevant parties if needed.

c.    If the issue relates to prepaid card transactions, refunds, or payment disputes, the matter shall be handled directly by the Partner Bank(s) as per their cardholder dispute and refund policies and in line with Nepal Rastra Bank (NRB) grievance directives.

d.    Nepal Now may facilitate communication between the User and Partner Bank(s) but is not responsible for financial decisions, refunds, or settlements handled under Partner Bank authority

2.7. Rejection of Terms: Users who do not agree with these Terms must not register, log in, or use any services offered through the Nepal Now App.

3.    Scope of Nepal Now App Services
The Nepal Now App provides electronic payment, prepaid card issuance, and related services to tourists and users in Nepal, enabling them to make payments like locals at merchants accepting Fonepay QR payments. Customers can download the Nepal Now App, complete registration with valid Passport, Visa, and contact information, and access services once identity and presence in Nepal are verified.
Nepal Now services include, but are not limited to:

1.    Creation and management of prepaid cards issued by the Partner Bank, including loading funds via Visa or Mastercard.

2.    Payments at merchants accepting Fonepay QR codes.

3.    Integration with third-party services such as Google Maps, Third Party APIs, and Partner Bank platforms, to facilitate payments, bookings, and location-based verification.

4.    Management of refunds, account balances, and transaction history in coordination with the Partner Bank.

5.    Customer support and dispute resolution services related to App usage.

Nepal Now services shall be subject to the limits, rules, and restrictions set forth by Nepal Now, the Partner Bank, and applicable regulatory authorities, including but not limited to daily, weekly, monthly, and annual transaction limits.
By using the Nepal Now App, the Customer acknowledges that services provided are reliant on the Partner Bank and third-party providers for payment processing, card issuance, refunds, and other financial operations. Nepal Now, acting as a technology provider, facilitates access to these services but does not directly manage financial transactions, card KYC, or refunds.
The Customer agrees that Nepal Now may, at its discretion, modify, suspend, or discontinue any service or feature of the App, provided that reasonable efforts are made to notify Customers of such changes.

4.    Rights and Obligations of the Customer
To access the Nepal Now services provided through the Nepal Now App, Customers must complete the registration process by providing valid Passport, Visa, and contact information, and undergo identity and location verification to confirm their physical presence in Nepal. A unique Username and Password set up by the Customer is created to identify the Customer in the Nepal Now system.
An OTP (One-Time Password) may be sent to the registered mobile number/email address for verification during registration and to authorize financial and non-financial transactions. Any financial or non-financial loss resulting from misuse of such information shall be the responsibility of the Customer.
To access prepaid card and payment services, the Customer acknowledges that the card is issued and managed by the Partner Bank, and Nepal Now acts solely as the technology provider. By using the App, the Customer agrees to comply with the Partner Bank’s terms for card issuance, loading funds, refunds, and transactions. Nepal Now provides technology facilitation for transactions, merchant payments, third-party API integration, and location verification, but does not directly handle financial operations.
The Customer has the following rights:

1.    To create and manage their Nepal Now account, including updating personal information and security credentials.

2.    To use the prepaid card for payments at merchants accepting Fonepay QR payments.

3.    To request a refund of remaining prepaid card balance, either voluntarily or upon visa expiry.

4.    To request reinstatement or access to the App for subsequent visits to Nepal, subject to valid visa verification.

5.    To delete or close their Nepal Now account at any time through the in-app settings[NN2.1]

The Customer has the following obligations:

1.    To provide accurate, complete, and current information for registration and verification.

2.    To ensure that they are physically present in Nepal and comply with all visa requirements while using the App.

3.    To maintain the confidentiality and security of Username, Password, OTP, and any other security credentials.

4.    To immediately notify Nepal Now of any unauthorized access, loss, or suspected compromise of credentials.

5.    To use the App and Services solely for lawful purposes and in compliance with applicable laws, Partner Bank policies, and these Terms.

The Customer acknowledges that any misuse of the App or Services, provision of false information, or violation of visa conditions may result in suspension of the account, termination of Services, and/or forfeiture of rights to refunds or access until compliance is restored.
Nepal Now may, at its discretion, monitor usage and enforce compliance with these Terms, including temporary suspension or permanent termination of Services for breaches or suspicious activity.

5.    Prepaid Card Issuance and Partner Bank Responsibilities
The Nepal Now App facilitates the issuance of prepaid cards to Customers for use in Nepal, enabling payments at merchants accepting Fonepay QR codes. The prepaid card is issued, managed, and governed by the Partner Bank(s), and Nepal Now serves solely as the technology provider for accessing and using the card through the App.
5.1.    Partner Bank Responsibilities
1.    Card Issuance: The Partner Bank shall be responsible for issuing the prepaid card after successful identity verification, visa validation, and registration in the Nepal Now App.
2.    KYC Compliance: The Partner Bank shall perform all Know Your Customer (KYC) processes, including verification of Passport, Visa, and other regulatory requirements. Nepal Now does not store or process KYC documents beyond facilitating secure submission.
3.    Transaction Processing: All financial transactions, including loading funds, payments to merchants, and balance management, are processed and recorded by the Partner Bank. Nepal Now technology facilitates the transaction interface but does not directly handle funds.
4.    Refunds and Disputes: Refunds of remaining card balance, dispute resolution, or card deactivation due to visa expiry or voluntary account closure shall be managed entirely by the Partner Bank, in accordance with their terms and regulatory obligations.
5.    Account Closure or Suspension: The Partner Bank has the authority to suspend or terminate prepaid card services if there is a regulatory requirement, breach of Terms, or expiry/violation of visa conditions. Nepal Now will notify the Customer of such actions when applicable.
5.2.    Customer Acknowledgment
1.    Customers acknowledge and agree that the Partner Bank, and not Nepal Now, is solely responsible for financial operations, card limits, fees, transaction disputes, and refunds.
2.    Customers agree to comply with the Partner Bank’s terms for the prepaid card, including transaction limits, usage policies, and security requirements.
3.    Customers understand that Nepal Now is a technology facilitator and will not be held liable for any financial loss arising from misuse of the prepaid card, transaction errors, or Partner Bank actions.
5.3.    Prepaid Card Usage Rules
1.    Cards may only be used for lawful payments and transactions in Nepal where Fonepay QR payments are accepted.
2.    Cards cannot be transferred, pledged, or used by any third party other than the registered Customer.
3.    Users must ensure that funds loaded onto the prepaid card are from legitimate sources and in compliance with Partner Bank and regulatory requirements.
4.    Nepal Now reserves the right to suspend access to the App if visa verification fails, or if the Customer’s visa expires. In such cases, Customers may request a refund of remaining balance or reactivate their account upon subsequent valid entry to Nepal.

6.    Visa Expiry, Account Suspension, and Refunds
1.    User accounts are automatically suspended when the visa on record expires.
2.    Suspended accounts may:
o    Request a refund of remaining prepaid card balance via Partner Bank(s).
o    Be reactivated upon verification of a new or extended visa.
3.    Users cannot access Services until the account is reactivated or closed.
4.    Refunds are processed exclusively by Partner Bank(s). Nepal Now cannot reverse, hold, or alter refunds.
5.    Users may opt for a full refund of prepaid card balance at any time via Partner Bank(s).

7.    Fees and Charges
a)    Users agree to pay any applicable service charges, card issuance fees, or transaction fees as defined by the Partner Bank(s) and Nepal Now.

b)    Nepal Now reserves the right to revise fees with prior notice via the App or official communication channels.

c)    Any taxes, duties, or regulatory levies shall be borne by the User as per applicable law.[NN3.1]

8.    Currency Conversion 
By using Nepal Now services, the User acknowledges and agrees that fund loadings made through international payment networks (such as Visa, Mastercard, or similar) may be subject to currency conversion based on the prevailing exchange rates and conversion fees determined by the respective Partner Bank(s) or the international payment network. Exchange rates may fluctuate and differ from market or published rates. Nepal Now does not determine or control such rates or fees and shall not be held responsible for any loss, variance, or additional charges arising from currency conversion or exchange rate differences.[NN4.1]

9.    Communication and Notifications
Nepal Now may communicate with Users via in-app messages, push notifications, SMS, or registered email. Such communications shall be deemed delivered once sent to the User’s registered contact details.[NN5.1]

10.    Security Practices
Nepal Now is committed to maintaining the highest standards of security to protect Customer information and ensure safe use of the App and its Services. The following measures are implemented to safeguard data and transactions:
10.1.    Customer Account Security
1.    Customers are responsible for maintaining the confidentiality and security of their Username, Password, OTP, and any other security credentials used to access the Nepal Now App.
2.    Customers must not share login credentials or OTPs with any third party. Any unauthorized access resulting from sharing of credentials shall be the responsibility of the Customer.
3.    Customers must immediately notify Nepal Now of any suspected compromise, unauthorized access, or misuse of their account.[NN6.1]
10.2.    Transaction Security
1.    All transactions conducted through the Nepal Now App, including prepaid card payments, loading of funds, and merchant payments, are secured using industry-standard encryption protocols.
2.    OTP verification is required for registration, adding funds, and completing all financial transactions to provide a second layer of authentication.
3.    Nepal Now employs monitoring mechanisms to detect suspicious activity and prevent unauthorized or fraudulent transactions.
10.3.    Device and Network Security
1.    Nepal Now collects device information such as device identifiers, IP address, browser information, and GPS location to enhance security and verify presence in Nepal.
2.    Customers are advised to use trusted devices and secure networks when accessing the App to reduce the risk of unauthorized access.
3.    Nepal Now may restrict or suspend access from devices or networks deemed insecure or suspicious.[NN7.1]
10.4.    Data Storage and Protection
1.    Customer data, including Passport, Visa, personal information, transaction history, and location data, are securely stored and processed in accordance with applicable laws and Nepal Now’s Privacy Policy.
2.    Nepal Now implements administrative, technical, and physical safeguards to protect data against loss, unauthorized access, disclosure, alteration, or destruction.
3.    While Nepal Now implements strong security measures, Customers acknowledge that no system is completely impenetrable, and the App cannot guarantee absolute security.
10.5.    Partner Bank Security
1.    Financial transactions, prepaid card management, and KYC verification are handled by the Partner Bank, which is responsible for maintaining compliance with all regulatory and security requirements.
2.    Nepal Now ensures that the technology interface with the Partner Bank meets security standards, but Nepal Now is not responsible for financial or operational security managed by the Partner Bank.
10.6.    Customer Cooperation
1.    Customers must follow security guidelines provided by Nepal Now and the Partner Bank.
2.    Customers agree not to attempt to bypass security measures or interfere with the App’s operation. Any violation may result in account suspension, termination of Services, or legal action.

11.    Third-Party Integrations
Nepal Now may integrate or interact with third-party services to enhance the functionality and user experience of the App. The following rules govern such integrations:
11.1.    Scope of Third-Party Integrations
1.    The App may include integrations with third-party services such as, but not limited to, Google Maps, merchant platforms, payment gateways, and other service providers that facilitate travel-related services and payments.
2.    These integrations may allow Users to access additional features, such as location services, navigation, hotel or activity bookings, and transaction processing.
11.2.    Data Sharing with Third Parties
1.    Certain personal, financial, or transactional data may be shared with third-party providers to enable App functionality and provide Services.
2.    Data shared may include, but is not limited to, Name, Contact Information, GPS location, Visa/Passport details, and prepaid card transaction information, as required to process services.
3.    Users acknowledge and consent that data shared with third parties will be governed by the respective third-party’s privacy policy.
11.3.    Liability and Responsibility
1.    Nepal Now acts solely as a technology provider and does not control, endorse, or guarantee the accuracy, legality, availability, or quality of services, content, or products offered by third parties.
2.    Nepal Now is not responsible for any loss, damage, or inconvenience arising from the use of third-party services, including technical failures, errors, or unauthorized access by third parties.
3.    Users agree that Nepal Now will not be liable for any disputes, claims, or damages arising from their interaction with third-party services or content accessed through the App.
11.4.    User Responsibility
1.    Users are encouraged to review the terms, privacy policies, and service agreements of any third-party service before sharing information or completing transactions.
2.    Any use of third-party services is at the User’s own risk, and Nepal Now does not provide mediation or resolution for disputes between Users and third-party service providers.

12.    Sharing of Information and Disclosures
Nepal Now collects, stores, and processes personal, financial, and transactional information of Customers to provide Services efficiently and securely. The following rules govern the sharing and disclosure of such information:
12.1.    Categories of Information Collected
1.    Personal Information: Name, email, phone number, passport, visa details, photo, and contact information.
2.    Location Information: GPS data used to verify presence in Nepal.
3.    Financial Information: Prepaid card transaction data, loading of funds, and merchant payments.
4.    Device Information: Device identifier, IP address, mobile device model, and other technical details for security purposes.
5.    Third-Party Integrations: Data from integrated services such as Google Maps and payment gateways.
12.2.    Purpose of Sharing
Nepal Now may share information under the following circumstances:
1.    Partner Bank: Passport, visa, personal information, and transaction data are shared with the Partner Bank for KYC compliance, prepaid card issuance, transaction processing, dispute resolution, and refund management.
2.    Service Providers: Information may be shared with third-party service providers, including technical, operational, and analytics providers, to enable App functionality and enhance the user experience.
3.    Merchants: Transaction-related information may be shared with merchants for payment verification and order fulfillment.
4.    Regulatory Authorities: Information may be disclosed as required by law or governmental authorities for compliance, audits, investigations, or regulatory obligations.
5.    Legal Proceedings: Information may be disclosed to protect the rights, property, or safety of Nepal Now, its Users, or others, or as required by law, subpoena, or court order.
12.3.    Customer Consent
1.    By using Nepal Now, Customers expressly consent to the collection, processing, and sharing of their information in accordance with this Policy.
2.    Customers represent that they have authority to provide their personal information, passport, and visa details, and consent to its use as outlined in these Terms and the Privacy Policy.
12.4.    Third-Party Policies
1.    Third-party service providers and Partner Banks have their own privacy and data handling policies. Nepal Now ensures that such third parties adhere to comparable privacy standards where applicable.
2.    Nepal Now is not responsible for the use or disclosure of Customer information by third parties beyond the purposes stated in this Policy.
12.5.    Information Retention
1.    Information will be retained only as long as necessary to provide Services, comply with legal obligations, or for dispute resolution.
2.    Once information is no longer required, it will be securely deleted in accordance with applicable laws and regulations.
12.6.    Data Minimization and Security
Nepal Now ensures that only the minimum required personal and financial information is collected and shared with third parties, and implements security measures to protect information in transit and at rest.

13.    Prohibited Activities
Users of the Nepal Now App are required to comply with all applicable laws, regulations, and these Terms. The following activities are strictly prohibited:
13.1    Illegal or Unauthorized Use
1.    Using the App for any unlawful purpose, including but not limited to fraud, money laundering, or financing of illegal activities.
2.    Impersonating any person, entity, or organization, or misrepresenting affiliation with any person or entity.
3.    Attempting to gain unauthorized access to the App, other Users’ accounts, or Nepal Now systems.
4.    Circumventing or attempting to circumvent any security or authentication measures implemented by Nepal Now.
13.2     Interference with Services
1.    Disrupting, damaging, or interfering with the App, its servers, networks, or any connected system.
2.    Introducing viruses, malware, malicious code, or any other harmful components into the App or associated systems.
3.    Using automated scripts, bots, or other methods to extract data or perform actions on the App without prior written consent from Nepal Now.
13.3    Misuse of Third-Party Integrations
1.    Engaging in unauthorized use of third-party services or content integrated within the App.
2.    Uploading or sharing content that infringes on the intellectual property rights of third parties.
3.    Violating any terms, conditions, or policies of third-party services linked to or accessed through the App.
13.4    Abuse of Prepaid Card Services
1.    Attempting to use the prepaid card issued by the Partner Bank in violation of the bank’s terms and conditions.
2.    Using the App or prepaid card for speculative, illegal, or unauthorized financial transactions.
3.    Sharing card details, credentials, or OTPs with unauthorized individuals.
13.5    Consequences of Prohibited Activities
1.    Any activity listed above or deemed unethical, improper, or harmful to Nepal Now, its Users, or third parties may result in immediate suspension or termination of the User account.
2.    Nepal Now reserves the right to refuse access, block transactions, and report violations to relevant authorities.
3.    Users engaging in prohibited activities may also be subject to civil or criminal liability under applicable laws.

14.     Limitation of Liability
14.1    General Disclaimer
1.    Users acknowledge and agree that their use of the Nepal Now App and Services, including prepaid card usage, third-party integrations, and payment processing, is at their own risk.
2.    Nepal Now provides the App as a technology platform and acts solely as a facilitator; the App does not directly provide banking, financial, or travel services. All transactions, refunds, and card-related services are managed by the Partner Bank.
14.2    No Liability for Third-Party Services
1.    Nepal Now shall not be liable for any errors, delays, malfunctions, or unavailability of services provided by third-party integrations, including but not limited to merchant platforms, payment gateways, and location services.
2.    Nepal Now does not guarantee the quality, safety, legality, or accuracy of products or services offered by third parties accessible via the App.
3.    Any disputes or claims arising from the use of third-party services must be resolved directly with the respective service provider.
14.3    No Liability for Losses or Damages
Nepal Now shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to loss of funds, loss of data, lost profits, or other economic or non-economic losses arising from:
a) Use or inability to use the App;
b) Unauthorized access to user accounts or prepaid cards;
c) Technical failures, network outages, or system downtime;
d) Errors in GPS/location verification, visa verification, or transaction processing;
e) Acts of third parties, including merchants, banks, or service providers; or
f) Events beyond Nepal Now’s reasonable control, including natural disasters, government actions, or cyberattacks.
14.4    User Responsibility
1.    Users are solely responsible for maintaining the confidentiality of their login credentials, OTPs, prepaid card information, and any other access mechanisms.
2.    Users agree to indemnify, defend, and hold harmless Nepal Now, its Partner Bank(s), affiliates, and employees from any claims, liabilities, damages, or expenses arising from the User’s misuse of the App, violation of laws, or breach of these Terms.[NN8.1]
14.5    Maximum Liability
1.    To the extent permitted by law, Nepal Now’s total liability to a User for any cause whatsoever shall be limited to the amount of the User’s prepaid card balance or the transaction value at issue, whichever is lower.[NN9.1]
2.    Nothing in this section shall exclude or limit liability for death or personal injury caused by Nepal Now’s gross negligence or willful misconduct.

15.     Intellectual Property
15.1.    Ownership:

All content, graphics, logos, page headers, button icons, scripts, service names, and designs used in the Nepal Now App, including its mobile application and associated websites, are either the property of Nepal Now or its affiliates and are protected under applicable intellectual property laws. Users may not use these trademarks, service marks, trade dress, or logos in any manner that could cause confusion or imply endorsement without the express written permission of Nepal Now.

15.2.    Copyrights:

All content within the Nepal Now App, including but not limited to text, graphics, software, photos, audio, video, selection and arrangement of content, underlying source code, and other materials, are protected by copyright laws, whether registered or unregistered. All rights are reserved.


15.3.    User-Generated Content:

Any content submitted, uploaded, or shared by Users on the Nepal Now App (such as feedback, reviews, or suggestions) shall remain the property of the User. By submitting such content, the User grants Nepal Now a worldwide, royalty-free, perpetual, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content for purposes of operating, promoting, or improving the App and its Services.

15.4.    Third-Party Intellectual Property:

Third-party content or services integrated into the Nepal Now App (e.g., Google Maps, merchant platforms, payment providers) remain the intellectual property of their respective owners. Use of such content is subject to the third party’s applicable terms and conditions, and Nepal Now is not responsible for any violation of intellectual property rights arising from the use of third-party services.

15.5.    Prohibited Activities:

Users shall not:
a) Copy, reproduce, distribute, create derivative works, publicly display, or exploit any content from the Nepal Now App without prior written consent;
b) Remove, obscure, or alter any copyright, trademark, or proprietary notices on the App;
c) Use the App or its content in a manner that infringes upon or violates any intellectual property rights of Nepal Now or any third party.
15.6.    Enforcement:

Nepal Now reserves the right to enforce its intellectual property rights to the fullest extent of the law. Users found violating these rights may have their accounts terminated, access to the App revoked, and legal action taken if necessary.

16.    User Deletion or Termination
16.1    Voluntary Account Disabling: 
A User may request to disable their Nepal Now account at any time through by contacting [email protected].
Before disabling, the User must ensure that:
a) The prepaid card balance has been refunded or withdrawn through the Partner Bank(s).
b) There are no pending transactions or disputes related to their account.
16.2    Data Retention After Disabling
Upon successful account disablement, access to the App and all related services will be disabled.
However, Nepal Now and the Partner Bank(s) will retain necessary personal and transactional data for a minimum period of five (5) years, or as required by Nepal Rastra Bank (NRB) and applicable laws, for audit, regulatory, and fraud-prevention purposes.
After the mandatory retention period, such data will be securely deleted or anonymized in compliance with Nepal Now’s Privacy Policy.
16.3    Reactivation
A blocked account can be reactivated at any time by sending a request to [email protected]. Upon verification, the account will be unblocked, restoring access and functionality without the need for a new registration or verification.
16.4    Termination by Nepal Now or Partner Bank(s)
Nepal Now or the Partner Bank(s) may suspend or terminate a User’s account without prior notice if:
a) The User violates these Terms or engages in fraudulent, unlawful, or suspicious activity.
b) The User’s visa expires or they are no longer physically present in Nepal.
c) Required verification documents are invalid, incomplete, or found to be falsified.
In such cases, any remaining prepaid balance will be refunded by the Partner Bank(s) in accordance with their refund policy and applicable NRB guidelines.
16.5    Effect of Deletion or Termination
[NN10.1]Blocking or termination of a Nepal Now account will result in the suspension of access to all Nepal Now services associated with that account.
Any pending obligations, transactions, or disputes at the time of account blocking or termination will continue to be enforceable and resolved in accordance with applicable rules and regulations of the Partner Bank and Nepal Rastra Bank (NRB).

17.    Termination
Nepal Now may suspend or terminate a user’s account if there is a violation of these Terms. Users also have the option to voluntarily close their accounts and request refunds through the Partner Bank(s). Termination of an account does not release Users from any outstanding obligations, disputes, or liabilities with the Partner Bank(s) or merchants.

18.    Governing Law and Dispute Resolution

These Terms are governed by the laws of Nepal. Any disputes arising from the use of the App shall be subject to the exclusive jurisdiction of the Kathmandu District Court. Disputes related to the prepaid card are separately governed by the Partner Bank(s) Terms and Conditions.

19.    Amendments

Nepal Now reserves the right to update these Terms at any time. Continued use of the App after such updates constitutes acceptance of the revised Terms. Significant changes will be communicated to Users via App notifications or email.

20.    Events Beyond Control

Nepal Now and Partner Bank(s) shall not be held liable for any delay or failure to perform their obligations under these Terms due to events beyond their reasonable control, including natural disasters, government restrictions, or system and network failures.

21.    Language and Interpretations

These Terms are provided in English and shall prevail in the event of any inconsistency with translated versions made available for convenience.[NN11.1]

22.    Waiver

Failure by Nepal Now to enforce any provision of these Terms at any time shall not be considered a waiver of its right to enforce that provision in the future.

23.    Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law.[NN12.1]

24.    Entire Agreement

These Terms, together with the Privacy Policy and any Partner Bank-specific terms, constitute the entire agreement between the User and Nepal Now and supersede any prior understandings or representations.[NN13.1]
