This document governs the privacy policy of our Mobile Application; hereinafter referred to as “Mobile App”.
This Privacy Policy is acknowledged and consented to by using the Fonepay App (Hereinafter “App”). Before using this app, please read this Privacy Statement carefully. By using our app, you acknowledge that you have read, understood, and agree to the terms and conditions of this Policy.
Fonepay Payment Service Limited ("Fonepay") is dedicated to safeguarding the privacy of its customers. Fonepay recognizes and respects users' concerns regarding their privacy, confidentiality, and security of information supplied to Fonepay through its App.
Fonepay uses cookies, log filed, pixel tags, local storage objects and other tracking technologies to automatically collect when users access and receive services from the App. Fonepay may receive the user’s personal and financial information in its capacity as a payment system operator and payment gateway, which may include but is not limited to the user’s name, phone number, email address, name of the bank, account number, withdrawal amount. Fonepay collects this data in accordance with statutory and regulatory regulations, as well as internal procedural and operating standards and bylaws. Fonepay's internal procedures, operational rules, and bylaws are all well-documented.
Fonepay collects user’s personal and financial information online primarily to deliver a more personalized experience for our users. Fonepay makes every effort to avoid collecting data that is excessive or irrelevant when doing so. Fonepay, as a corporate body and payment system operator, keeps records and information safe and secure in accordance with its policy and in accordance with statutory provisions and directions for the time period required by it.
The data collected by Fonepay is kept in electronic files on Fonepay's system, as well as authorized archives. Fonepay does not in any way enable unauthorized access to any of the information it stores. Fonepay ensure further protection of the collected data by including a confidentiality clause in its agreements with entities doing business with it, requiring them to keep personal information secure and confidential and not to divulge it to outsiders unless required by law, a court order, or an explicit instruction from Fonepay.
To avoid any loss or damage to the collected information, Fonepay uses best efforts to implement adequate operational, physical, electronic, procedural, and technical measures against any unauthorized access or breach of data security. Fonepay, on the other hand, will not be held responsible in any way for any default. The following are some of the most important characteristics of an information security system:
Fonepay may use the collected information for the following purposes:
Provision of the Services: Fonepay may use the information collected about the user to provide its services through the App.
Email Communications: By completing the registration process users agree to our use of the registration information and other information that is collected to send email communications, including advertisements and other promotional materials from third party sponsors.
User Profiles: Fonepay may associate information that have been collected about the use of the services to create the user’s profile that Fonepay may update from time to time.
Account Management: Fonepay may use user information to administer the user account, respond to user inquiries, fulfill user requests and send users administrative communications about the services.
Investigations: Fonepay may use user information to detect, investigate and defend against fraudulent or unlawful activity and violations of our commercial terms.

Without limiting Fonepay's other rights under these terms and conditions, if a user commits a breach of any of the terms and conditions of this Privacy Policy in any way, Fonepay may take any action it deems appropriate to deal with the breach, including suspending the user’s access to the App, prohibiting the user from accessing the App, blocking devices using the user’s IP address from accessing the App.
You may terminate the linking of your bank accounts and payment methods with the Fonepay app at any time by delinking them from within the app settings. However, please note that due to regulatory requirements and our data retention policies, we will retain certain account information and transaction records even after delinking your accounts.
Upon delinking your accounts, you will no longer be able to initiate transactions within the Fonepay app. However, you will still be able to access the app and its other features.
Fonepay reserves the right to delink your accounts at any time, without prior notice, if we have reasonable grounds to believe that you have violated these terms and conditions, engaged in fraudulent or illegal activities, or if required by law or regulatory authorities.
After delinking your accounts, your personal data related to those accounts will be retained for the period necessary to comply with legal obligations, resolve disputes, and enforce our agreements. We will securely delete or anonymize your personal data in accordance with our data retention policies and applicable laws.
Please note that delinking your accounts from the Fonepay app does not automatically terminate any separate agreements or accounts you may have with Banks and Financial institutions, or service providers linked to your Fonepay App. You are responsible for managing those relationships separately.
Fonepay may revise this Privacy Policy from time-to-time. Revised Privacy Policy shall apply from the date of the publication of the same on this App.
This Privacy Policy shall be regulated by the Privacy Act, 2075 of Nepal and other relevant prevailing laws of Nepal and the terms of this Privacy Policy shall be understood and construed in compliance with it. The Courts of Kathmandu in Nepal shall have exclusive jurisdiction and venue over any action relating to the subject matter of this Agreement, and each of the parties hereto submits to the exclusive jurisdiction and venue of such courts for the purposes of any such action.
Email correspondence made to Fonepay is considered a record and will be kept for as long as the law requires. Unless required by law, senders' names and addresses are not added to a mailing list or released to third parties without their consent. Fonepay App support employees may monitor email messages for system troubleshooting and maintenance needs.
